Over the last several years dishonest and deceptive sales practices over the Internet have become increasingly pervasive and sophisticated. Although unscrupulous merchants that engage in such conduct, with the assistance of certain banks and other third parties that facilitate such conduct, are, as a percentage of all merchants, relatively small, these actions have had the effect of putting in doubt the integrity and honesty of all merchants that offer goods or services over the Internet. A recent U.S. Senate investigation into the world of 'mystery charges' on consumers' credit card statements revealed that a substantial number of well known online merchants routinely engaged in practices viewed by lawmakers as little more than scams and frauds, duping online purchasers out of a collective $1.4 billion. Not surprisingly, surfers are ever more wary of engaging in credit card transactions over the Internet because of a fear that they cannot rely on the integrity of the online purchase process. Because of this fear, online merchants, the card associations that permit merchants to use their cards in the online purchase process, and honest banks, among others, have all been negatively impacted both financially and otherwise.
